Terms & Conditions for Training Camp Competition

The following Terms & Conditions apply to the UBX Training Camp 6 week challenge Competition, which is run seasonally in our gyms, and on our iOS and Android Apps ("The Training Camp"):

  1. The Promoter of this competition is UBX Australia Pty Ltd ABN 33 169 373 371, 6/2 Baroona Rd,Brisbane QLD 4064
  2. The competition commences on 28th January 2024 at 01:00 (AEST) and concludes on 29th March 2024 at 23:59 (AEST).
  3. The challenge period commences on 5th February 2024 at 01:00 (AEST) and concludes on 16th March 2024 at 23:59 (AEST).
  4. Entry is open to all “Training Camp” participants globally, and must be a paying member of a UBX gym throughout the competition period. Employees and franchisees of the Promoter are not eligible to enter.
  5. Participants must be at least 18 years of age to enter.
  6. This competition is not in any way sponsored by Apple.
  7. To enter the “Major Prize” competition, participants must:
    • Register participation by clicking the join button on the Training Camp app. Download the app via https://ubx.fit/tc
    • Submit your benchmarks and body metrics via the Training Camp app (under the Challenges screen).
    • Speak to your gym about submitting your entry at the end of camp, understanding you will require the following;
      1. Submit “Before” photos taken of their full body (front, back and side view). The “Before” photos must be taken within 7 days of the challenge commencing.
      2. Submit “After” photos taken of their full body (front, back and side view). The “After” photos must be taken within 7 days of the end of the challenge.
      3. Submit a digital copy of a “Before” body composition scan. The “Before” body composition scan must be completed within 7 days of the challenge commencing.
      4. Submit a digital copy of an “After” body composition scan. The “After” body composition scan must be completed within 7 days of the challenge concluding.
      5. Submit the results of their 3 x Benchmark workouts completed in the first 7 days of the challenge.
      6. Submit the results of their 3 x Benchmark workouts completed in the last 7 days of the challenge.
  8. UBX reserves the right to disqualify or remove any participant from the competition if they submit inappropriate or explicit images.
    • Participants are encouraged to refer to our guide on taking before/after photos to ensure they adhere to our standards.
  9. Incomplete entries will be deemed invalid.
  10. Benchmark workouts must be completed as instructed via the training program.
  11. There will be (2) winners of the prize as detailed below.
  12. No part of the prize is exchangeable, redeemable for cash or any other prize or transferable.
  13. Total Major prize valued at 2 x AUD$7,500
  14. The Major prize consists of:
    • A “Climbing Mountains” adventure: Mount Kilimanjaro guided trek commencing on 14 September 2024 (valued at AUD$5,332.80)
    • A Travel voucher (valued at AUD$2,000)
    • A UBX Prize Pack (valued at AUD$263.90)
  15. By accepting the prize, the winner agrees to the terms and conditions set forth by “Climbing Mountains” for the prize and understands there will be costs incurred and exclusions applicable to the trek. The winner will also be required to bring their own equipment for the trek. Further detail on the exclusions and required equipment can be found at: https://climbingmountains.com.au
  16. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize. This includes the use of the photos and information provided as part of their competition entry.
  17. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with UBX Training or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  18. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  19. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
  20. The draw will take place at UBX HQ 6/2 Baroona Rd Milton QLD 4000, Australia and the winner will be notified by phone within 7 business days.
  21. The prize will be awarded to the person named in the entry.
  22. Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  23. The Promoter’s decision is final, and the Promoter will not enter into correspondence regarding the competition result.
  24. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
  25. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
  26. The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  27. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  28. The collection and disclosure of personal information provided in connection with this promotion will be handled in accordance with the Promoter's Privacy statement which adheres to the Privacy Act 1988 (Cth) and Australian Privacy Principles.
  29. Entrants consent to the Promoter using the personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding the prize, including to third parties involved in the promotion and any relevant authorities. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter including third parties may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity and research purposes, including sending electronic messages or telephoning the entrant. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact the Promoter. Any request to update, modify or delete the entrant’s details should be directed to the Promoter.
